Massachusetts ABCC Regulations and Decisions

MartiniThe Massachusetts Alcoholic Beverages Control Commission’s website spells out the mission of the ABCC and what it is authorized to do.

…to promulgate regulations clarifying, carrying out, enforcing and preventing any violation of the provisions of M.G.L. c. 138…These regulations (such as “Happy Hour” and “Tap a Keg”)  control the method by which a business with an alcoholic beverages license is conducted, and must be followed, where applicable. A violation of any regulation of the ABCC may be prosecuted against a licensee either criminally (to impose the available criminal penalties of fine and/or imprisonment) or administratively (to impose a suspension, revocation, cancellation or modification on the alcoholic beverages license).

These regulations and decisions are laid out in detail in separate sections on the agency’s website.  The site also currently lists decisions in cases heard by the ABCC from 2009, 2010, and 2011.  The 2012 decisions are expected to be posted soon.   The bulk of the ABCC regulations detailed on the other page form the basis for the ABCC’s Frequently Asked Questions section of the website.
